ADU Rules in Irvine (2026): What You Can Build

An accessory dwelling unit (ADU) is a second, self-contained home on a residential lot, with its own kitchen, bathroom and entrance. The City of Irvine permits ADUs and junior ADUs (JADUs) under California ADU law (Government Code 66310–66342); its own 2018 ordinance was found non-compliant by the state in January 2025, so the city now reviews applications to the state standard: a detached ADU of up to 1,200 sq ft, and at least 800 sq ft on virtually any single-family lot. ADU rules in Irvine at a glance

Irvine’s ADU ordinance (Ordinance 18-05, Zoning Ordinance Chapter 3-26) was found non-compliant by the California Department of Housing and Community Development (HCD) in January 2025 on 29 points, among them 5-foot setbacks, a 15.5-foot height cap, lot-size-based size tables and an owner-occupancy rule. The city told HCD it treats that ordinance as null and void and processes applications “per state statute,” so these are the rules it must apply.

Size, height and setbacks

The 1,200 sq ft detached ceiling is the number most Irvine homeowners ask about. On the tight lots of Northwood, Westpark and later Woodbridge, the 800 sq ft guarantee matters more: lot coverage, floor-area ratio, open-space and front-setback rules cannot be used to stop an ADU of at least 800 sq ft with 4-foot side and rear setbacks. Above 800 sq ft the city may apply its ordinary lot-coverage standards, so a 1,200 sq ft unit on a 5,000 sq ft lot may not fit. Our ADU rules calculator shows the state-law floor for your lot.

Detached height is 16 feet, or 18 feet within half a mile of a major transit stop or high-quality transit corridor, which describes some, not all, of Irvine; we check the parcel before promising a second story. An attached ADU, including one over an attached garage, can go to 25 feet or the main house’s height limit, whichever is lower, which makes above-garage units workable in the two-story 1980s–90s villages; HCD told Irvine it can no longer confine such a unit to the garage footprint.

Two local twists still apply. Turtle Rock, Shady Canyon, Orchard Hills and other hillside neighborhoods include parcels in Very High Fire Hazard Severity Zones under the Orange County Fire Authority, where a new ADU is built to Chapter 7A ignition-resistant standards with a Class A roof. And almost every Irvine home sits inside a master-planned village with an architectural committee. Under Civil Code 4751 a village association cannot prohibit or unreasonably restrict an ADU, but it can impose reasonable design conditions, and in practice it reviews roof form, materials and colors before the city permit is issued.

Garage conversions and JADUs in Irvine

Converting a garage is the most common ADU in Irvine’s 1960s–80s villages, and the easiest to approve. A conversion of existing space needs no side or rear setback, no parking space, and no replacement of the parking it removes, and the structure can be expanded by up to 150 sq ft solely to provide an entrance. Fire sprinklers follow the main house: if the house does not have them, the ADU does not need them, and building the ADU cannot trigger a sprinkler requirement for the house. A JADU is up to 500 sq ft inside the existing house or attached garage, with its own outside entrance, an efficiency kitchen, and a bathroom that may be shared with the house. If the bathroom is shared, the owner must live on the property, in either unit, and a deed restriction is recorded against separate sale. One ADU and one JADU are allowed on the same lot, so a Woodbridge home could have a garage JADU and a detached backyard ADU. HCD also confirmed in March 2025 that a detached townhouse on its own lot, common in Irvine, qualifies for a JADU.

Pre-approved plans, fees and utilities

Irvine’s Pre-Approved ADU Plans Program describes architectural and structural plans by licensed professionals, submitted with a permit application and a site-specific review; when we checked, the plan library was listed as “coming soon,” so ask Planning before counting on it. Los Angeles’s program does not apply in Irvine; see Los Angeles ADU standard plans for that city.

Irvine runs ADU cases on a deposit basis: plan check and inspection charges are drawn against a Developer Deposit, and the city publishes no flat ADU fee. Expect plan check, permit and inspection fees, a school fee determination from your district (Education Code 17620 lets districts charge only on ADUs larger than 500 sq ft), a Transportation Corridor Agency form, and Irvine Ranch Water District connection charges. Impact fees are prohibited under 750 sq ft and proportional above. The city’s submittal list also includes a recorded covenant; state law does not allow one to be required for an ADU on a single-family lot (a JADU does require one), and HCD raised this with the city in 2025.

For an ADU created inside existing space, or a JADU, neither the city nor the water district can require a separate utility connection or charge a connection fee or capacity charge; for a new detached ADU they may, proportionate to its size or fixture count. Electrical service changes go through Southern California Edison, and a detached unit often means a panel upgrade, performed by licensed electricians and scheduled and supervised by us as your general contractor.

The permit process in Irvine, step by step

  1. Village architectural review. Submit elevations, materials and colors to your village’s committee first; this typically adds two to four weeks and must be cleared before the city issues the permit.
  2. Request the ADU Verification Form from the Planning Team (planning@cityofirvine.org, 949-724-6308).
  3. Submit through IrvineReady (select “For Permitting–Other”): ADU permit application, plans and calculations, Development Standards Checklist, Hold Harmless Affidavit, owner and applicant affidavits, deposit set-up, school fee and Transportation Corridor Agency forms, and address application. The city checks completeness in about two business days and emails a payment link; processing starts when the deposit is paid.
  4. Plan check. The city has 60 days from a complete application to approve or deny.
  5. Permit and construction. Inspections run foundation, underground plumbing, framing, rough trades, insulation, drywall, final.
  6. Final inspection and certificate of occupancy, after Irvine Ranch Water District and Southern California Edison sign-offs.

End to end, an Irvine ADU runs six months to a year from first design meeting to move-in, with village review and plan check taking one to three months of that.

What an ADU costs in Irvine

Can my Irvine HOA or village association stop my ADU?

No. Under Civil Code 4751, any village CC&R that prohibits or unreasonably restricts an ADU or JADU on a single-family lot is void. The association can still apply reasonable architectural conditions, and in Irvine that means the village committee reviews the design before the city issues the permit.

Does Irvine require a parking space for an ADU?

Irvine can require at most one parking space per ADU, and none at all if the unit is within half a mile of public transit or is a conversion of existing space such as a garage. When a garage is converted or demolished for an ADU, the city cannot require the lost parking to be replaced.

Do I have to live on the property to have an ADU in Irvine?

No. State law prohibits owner-occupancy requirements for ADUs, and HCD told Irvine in 2025 that its old owner-occupant rule could not be enforced. A junior ADU is different: if it shares a bathroom with the main house, the owner must live in either the house or the JADU.

How long does ADU permitting take in Irvine?
